A Historic Partnership: Atlanta Children’s Health Care
Atlanta Children’s Health Care CHOA provides free access to certain materials and information, documentation, forms, questionnaires, and charts related to the study, prevention, and treatment of concussions through this website and its related pages, including, for your reference or download (collectively, the “Concussion Program Materials”) (“Agreement”). By accessing Concussion Program Materials, you agree to the terms.
1. Right of Access and Use. CHOA grants you a paid, non-transferable, non-exclusive licence to access, download, and use Concussion Program Materials only for the following purposes:
(i)If you’re a parent, you can use the Concussion Program Materials to educate yourself and your family about concussion prevention and treatment for a child;
(ii)As a coach or school organisation, you can use the concussion programme materials to promote concussion safety for your staff, students, and athletes and to create concussion management procedures. Y
(iii)If you’re a healthcare provider, you can use concussion programme materials for personal and professional development. You agree that the concussion programme materials are not definitive diagnostic tools for any patient and that you will use your own medical judgement.
Keep all CHOA notices in Concussion Program Materials. You may not copy, modify, adapt, reverse engineer, or create derivative works from the Concussion Program Materials.
Schools and athletic organisations may co-brand certain Concussion Program Materials with CHOA’s written consent. Schools, sports programmes, and recreational leagues can customise the Concussion Policy with their logo.
CHOA may update, replace, or remove some or all Concussion Program Materials; check the website to see if the materials you downloaded are current.
2. Reserve of Rights. Except for the limited licence in Section 1 of this Agreement, you have no express or implied licence, right, or proprietary interest in the Concussion Program Materials or their copyright, trademark, or other intellectual property rights. CHOA reserves all rights not expressly granted.

3.The concussion program. Informational materials are not medical advice. Concussion programme materials don’t create a doctor-patient relationship and shouldn’t replace medical advice and treatment.

By licencing the Concussion Program Materials, the CHOA assumes no obligation to update them. You are responsible for reviewing and approving their use.
4. No warranties.The Concussion Program and all related materials are provided “as is” and CHOA disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
5. Limitation of Liability. IN NO EVENT SHALL CHOA OR ITS AFFILIATES, OR ANY OF THEIR OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AGENTS OR REPRESENTATIVES, BE LIABLE TO YOU FOR INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES OR LOSS OF GOODWILL OR PROFITS ARISING OUT OF OR RELATING TO THIS AGREEMENT CHOA and its affiliates, and their officers, directors, shareholders, employees, agents, and representatives, are not liable for damages exceeding $100.
6. Applicable Law. This Agreement is governed by Georgia law, without regard to its conflict of law rules.
7. Generalities. This Agreement supersedes any prior understanding or agreement regarding its subject matter.
In any legal proceeding related to this Agreement or the Concussion Program Materials, you waive your right to a jury trial. If any provision of this Agreement is invalid, the rest will remain in effect.
